IL SISTEMA DI INFORMAZIONE SCHENGEN (SIS)
ESERCIZIO DEI DIRITTI
Il Garante per la protezione dei dati personali, quale Autorità di controllo e di vigilanza sulla Sezione nazionale del Sistema informativo Schengen (N.SIS), esercita il controllo sui trattamenti di dati personali registrati nel S.I.S., ai sensi degli articoli 55 del Regolamento (UE) 2018/1861, 69 del Regolamento (UE) 2018/1862, 154 del decreto legislativo 30 giugno 2003, n. 196 (Codice in materia di protezione dei dati personali) e 37 del decreto legislativo 18 maggio 2018, n. 51, al fine di assicurare il rispetto dei diritti degli interessati e, in particolare, dei diritti di accesso, rettifica e cancellazione (artt. 53 Reg. 2018/1861 e 67 Reg. 2018/1862).
Gli interessati esercitano i diritti di accesso, rettifica e cancellazione dei propri dati personali contenuti nel Sistema informativo Schengen (SIS) mediante richiesta indirizzata direttamente al Ministero dell’Interno - Dipartimento della pubblica sicurezza, quale autorità centrale competente sulla sezione nazionale del SIS (N.SIS), utilizzando i seguenti modelli:

Nel caso in cui la richiesta non sia stata riscontrata in tutto o in parte dal Ministero dell’Interno – Dipartimento della pubblica sicurezza, l'interessato può proporre reclamo al Garante per la protezione dei dati personali al seguente indirizzo:

Il reclamo può essere sottoscritto direttamente dall'interessato oppure, per suo conto, da un rappresentante. In tale ultimo caso, è necessario trasmettere, assieme a tutta la documentazione utile ai fini della valutazione del reclamo, la procura relativa al conferimento dell’incarico.
Il reclamante può presentare l'atto al Garante utilizzando la modalità ritenuta più opportuna fra le seguenti:
a) messaggio di posta elettronica certificata indirizzata a: protocollo@pec.gpdp.it
(questo indirizzo è configurato per ricevere SOLO comunicazioni provenienti da posta elettronica certificata)
b) raccomandata A/R indirizzata a: Garante per la protezione dei dati personali, Piazza Venezia, 11 - 00187 Roma
c) consegna a mano presso gli uffici del Garante per la protezione dei dati personali, Piazza Venezia, 11 - Roma
Il reclamo e l'eventuale procura devono essere sottoscritti con firma autenticata, con firma digitale o con firma autografa (in tale ultimo caso, al reclamo deve essere allegata copia di un documento di riconoscimento dell’interessato/a in corso di validità).
Al fine di agevolare un più sollecito riscontro dei reclami, è opportuno che gli stessi siano redatti in italiano, inglese o francese. É inoltre opportuno che le richieste siano pienamente leggibili e contengano un idoneo recapito dell'istante (possibilmente postale o PEC) dove l'interessato possa agevolmente ricevere la riposta.
Per ulteriori indicazioni sul diritto di accesso al SIS e sugli altri diritti riconosciuti al cittadino nonché sulle modalità di esercizio di tali diritti negli altri Paesi dell'ambito Schengen, può essere consultata l'apposita Guida per l'esercizio del diritto di accesso.

EXERCISE OF RIGHTS
The Garante per la protezione dei dati personali (Italian Data Protection Authority), as the supervisory authority for the National Section of the Schengen Information System (N.SIS), exercises control over the processing of personal data entered in the S.I.S., pursuant to Articles 55 of Regulation (EU) 2018/1861, 69 of Regulation (EU) 2018/1862, 154 of Legislative Decree No. 196 of 30 June 2003 (Personal Data Protection Code) and 37 of Legislative Decree No. 51 of 18 May 2018, in order to ensure compliance with the rights of data subjects and, in particular, the rights of access, rectification and erasure (Articles 53 of Regulation 2018/1861 and 67 of Regulation 2018/1862).
Data subjects may exercise their rights of access, rectification and erasure of their personal data contained in the Schengen Information System (SIS) by sending a request directly to the Ministry of the Interior - Department of Public Security, which is the central authority competent for the National Section of SIS (N.SIS). The request may be submitted using the following forms:

Should the request not be met in whole or in part by the Ministry of the Interior – Department of Public Security, the data subject may lodge a complaint with the Garante per la protezione dei dati personali at the following address:

The complaint may be signed either by the data subject or by a representative acting on their behalf. In the latter case, the power of attorney for the appointment of the representative must be sent together with all the documentation necessary for the examination of the complaint.
The complainant may lodge a complaint with the Garante by any of the following means:
a) certified email (PEC) addressed to: protocollo@pec.gpdp.it
(this address is set up to receive ONLY communications from certified email)
b) registered mail with return receipt addressed to: Garante per la protezione dei dati personali, Piazza Venezia, 11 - 00187 Rome
c) hand delivery to the offices of the Data Protection Authority, Piazza Venezia, 11 - Rome
The complaint and any power of attorney must be signed with a certified signature, a digital signature or a handwritten signature (in the latter case, a copy of a valid identity document of the data subject must be attached to the complaint).
In order to ensure that complaints are addressed as quickly as possible, they should be written in Italian, English or French. Furthermore, requests should be fully legible and include the applicant's contact details (preferably a postal address or certified email address) where the data subject may easily receive a reply.
